In the event a product is listed at an incorrect price due to typographical error or error in calculation or error in pricing information received from our suppliers, SystemsStore.com shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. SystemsStore.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card or SystemsStore.com account charged. If such charges have been made for a purchase and your order has been canceled, SystemsStore.com shall immediately issue a credit to the appropriate account in the amount of the incorrect price charged.

7. Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. SystemsStore.com reserves the right at any time after receipt of your order to accept or decline your order for any reason. SystemsStore.com reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders, other than those by a verified credit card purchase, must obtain pre-approval through completion and approval of the SystemsStore.com credit application (see link on SystemsStore Front Page). We may require additional verifications or information before accepting any order.

8. Terms of Sale
The amount of any purchase made on this web site is due at the time the order is placed unless a credit application has been submitted and approved. If you apply for and receive credit approval the terms of sale on any purchase from this web site are NET 30 DAYS FROM DATE OF INVOICE. Any credit account remaining unpaid in full or in part beyond that date will be considered past due, and will incur a service charge of 1.5% per month on any past due amount. You will be responsible to SystemsStore.com for any and all reasonable attorneys' and collection fees incurred by SystemsStore.com in obtaining full payment.

9. Minimum Order
In order to continue providing the quality of service you’ve come to expect from us, the minimum order requirement for each and every SystemsStore.com order is $50.00, before shipping and tax charges.

10. Shipping
To better serve the needs and desires of our customers, SystemsStore.com charges flat rate shipping based on product billings. This method allows our customers to know the total amount of shipping on any order - at the time of ordering. No guesswork, no surprises. The minimum shipping charge is $12.50. The sub-total of Product Billing (before taxes and shipping) will be multiplied by a shipping percentage based on three incremental levels of sales value: $0-500.00; 10%, $500.01-1500.00; 7.5%, $1500.01 and over; 5%. Shipping charges will apply to free items such as sample kits and catalogs when requested from outside the United States.

The standard shipping method for SystemsStore.com is via DHL, FedEx, or UPS. The shipping rates above are for shipments within the continental United States via FedEx Ground. Shipments via other methods or shippers - including overnight, next day, international, etc - will be charged the actual cost of shipping but not less than the minimum shipping charge based on the percentage of sales calculation. Non-standard shipments will incur a $7.50 handling charge in addition to all other shipping and handling charges.

11. Sales Tax
If applicable, state sales tax will be added to your invoice.

12. Return Policy
Products may be returned to SystemsStore.com for replacement or refund in the following manner:
a. Returns to SystemsStore.com must be made within 30 days of the invoice date. After 30 days, you must make all returns directly to the manufacturer of your product. Before returning any item, you must contact our Customer Service Department for a Return Merchandise Authorization number (RMA). No returns, of any type, will be accepted without an RMA number. RMA numbers are valid for 10 business days and all returns must be received during that time. You are responsible for all shipping costs of all returns. C.O.D. returns will not be accepted.

b. If you are seeking replacement of a defective product, you must place a new order for the identical product. When SystemsStore.com receives the returned defective product, you will be credited in full for the defective product price plus the original shipping cost. If part of a product becomes defective, the full product must be returned for credit or replacement.

c. In order to receive a refund for a non-defective product return, your purchase must be returned with shipping pre-paid. Returns are subject to a 20% restocking charge. All items must be in "as new" condition, in original packaging and with all warranty cards, manuals, and accessories. The original packing slip must be included and the RMA number visible on the package. Any discrepancies could result in a delay or partial forfeiture of your refund.

d. Any claims or discrepancies for shipment must be made within 5 days of receipt of products. Please notify Systemsstore.com by phone at 1-407-656-3719, or by e-mail at sales@systemsstore.com to make arrangements to correct your order.

13. Manufacturer's Warranty
All returns and replacements occurring after 30 days from the invoice date must be made directly with the manufacturer. Manufacturer's warranties vary on each product. Manufacturer information is subject to change without notice.

14. Service and Support
All requests for technical service and support should be made directly to the manufacturer in accordance with their terms and conditions.

15. Bulletin Board
The SystemsStore.com Bulletin Board provides a free location for sellers of used equipment to list items for sale. Balsys Technology Group, Inc. and SystemsStore.com are not involved in any actual transaction between seller and buyer. As a result, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, or the ability of sellers to sell items or the ability of buyers to buy items. Because we are not involved in any transaction between buyer and seller, other than as a location to list information, you release SystemsStore.com (and all officers, directors, agents, and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with any dispute between regarding any item of equipment listed on the SystemsStore.com Bulletin Board.

16. Indemnity
You agree to indemnify and hold SystemsStore.com and our subsidiaries, affiliates, officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

17. Legal Compliance
You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our web site and your purchase of items on this web site.

18. Fraud
Without limiting any other remedies, SystemsStore.com may suspend or terminate your account, or web site access, if you are found to have engaged in fraudulent activity in connection with our web site.

19. Arbitration and Applicable Law
Any controversy or claim arising out of or relating to this Agreement, our web site, or our services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Winter Garden, Florida, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or SystemsStore.com may seek any interim or preliminary relief from a court of competent jurisdiction in Winter Garden, Florida, necessary to protect the rights or property of you or SystemsStore.com pending the completion of arbitration.

This Agreement shall be governed in all respects by the laws of the State of Florida, and applicable federal laws, as such laws are applied to agreements entered into and to be performed entirely within Florida between Florida residents. If any portion of this Agreement is unlawful, invalid, or unenforceable, then such portion of this Agreement shall be deemed severed herefrom and shall not affect the validity or enforceability of the remainder of this Agreement.

20. Headings
Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.

21. Failure to Act
Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
